Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you" or "user")and Happy People AI LLP ("we", "us" or "our") governing your access to and use of our platform including our website and services (collectively the "Platform"). By using our Platform you agree to comply with these Terms.

If you do not agree with these Terms you must discontinue use of the Platform immediately.

1. Agreement to Terms

By accessing or using the Platform you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you are accessing or using the Platform on behalf of an entity, you represent that you are authorized to agree to these Terms on its behalf.

2. Eligibility

The Platform is intended for users who are at least 18 years of age. By using the Platform, you represent and warrant that you meet this eligibility requirement and are of legal age to form a binding contract.

3. User Accounts

You may need to register for an account to access certain services on our Platform. You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the confidentiality of your password and account credentials.
  • Be responsible for all activities that occur under your account.

We reserve the right to suspend or terminate your account if you provide false or misleading information, engage in prohibited activities, or otherwise violate these Terms.

4. Prohibited Activities

You agree to use the Platform only for lawful purposes. You are prohibited from:

  • Using NSFW words in usernames.
  • Creating fake identities or accounts.
  • Sharing your login credentials or using another user's account.
  • Impersonating any individual or entity.
  • Engaging in data scraping, automated data collection, or similar activities.
  • Posting content that is offensive, abusive, or violates intellectual property rights.
  • Uploading harmful content such as viruses or malware.

We reserve the right to remove content or terminate accounts that violate these Terms.

5. Intellectual Property Rights

All content on the Platform, including text, graphics, logos, and software, is owned or licensed by Happy People AI LLP and is protected by intellectual property laws. You may not reproduce, modify, or distribute any content from the Platform for commercial purposes without our prior written permission.

Users retain ownership of any content they create or post on the Platform (e.g. resumes, profiles). However, by posting content, you grant Happy People AI LLP a worldwide royalty-free license to use and share this content for marketing purposes subject to your consent.

6. User-Generated Content and Media

Users may contribute content (e.g. resumes, forum posts) to public areas of the Platform. You represent and warrant that any content you upload:

  • Does not infringe any third-party rights.
  • Is not defamatory, obscene, or harmful.
  • Complies with all applicable laws and regulations.

We reserve the right to moderate, remove, or edit any user-generated content that violates these Terms.

7. Social Media Integration

Users can link their social media profiles (e.g. LinkedIn) to their accounts on our Platform. However, we will not post on your behalf without your explicit consent. Users can also use Google to sign up and log in.

8. Fees, Payment, and Refunds

We offer certain services on a subscription basis. By subscribing, you agree to provide accurate payment information and authorize Razorpay to process your payments.

All payments are final and refunds are available only if requested within 24 hours of purchase. Refunds will be initiated within 5-7 business days.

You may cancel your subscription at any time, but your account will remain active until the end of the current subscription period. We do not automatically renew subscriptions or charge users after the subscription expires.

9. Service Availability

We strive to provide uninterrupted access to the Platform, but cannot guarantee that the Platform will always be available. We may need to perform maintenance, updates, or address technical issues which may result in temporary service interruptions. We will notify users of any significant interruptions via email or in-app notifications.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any significant changes by email or through notifications on the Platform. Your continued use of the Platform after such updates constitutes your acceptance of the revised Terms.

11. Indemnification

You agree to indemnify, defend, and hold harmless Happy People AI LLP, its officers, employees, and agents from any and all claims, liabilities, damages, or expenses, including reasonable legal fees, arising from:

  • Your use or misuse of the Platform.
  • Your violation of these Terms.
  • Your infringement of any third-party rights, including intellectual property rights.

12. Limitation of Liability

To the fullest extent permitted by law, Happy People AI LLP will not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Platform, including but not limited to:

  • Data loss, service interruptions, or unavailability.
  • Unauthorized access to user data.
  • Any bugs, viruses, or harmful content transmitted via the Platform.

Our liability is limited to the amount paid by you for services during the three (3) months preceding the occurrence that gives rise to the claim.

13. Governing Law and Arbitration

These Terms and any disputes arising from your use of the Platform are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts located in Hyderabad, India.

If a dispute arises that cannot be resolved informally, both parties agree to resolve the matter through arbitration in Hyderabad, India. Arbitration will be conducted under the laws and procedures specified by Indian arbitration law. The decision of the arbitrator will be binding on both parties.
